Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and My Course Academy ("we", "us", "the Platform"). By creating an account, purchasing a course, or subscribing to a Creator plan, you agree to these Terms. If you do not agree, do not use the Platform.

1. Accounts & eligibility

You must be at least 18 years old, or the age of majority where you live, to create an account. You are responsible for the accuracy of your account information and for all activity under your credentials. Keep your password confidential and notify us promptly of any unauthorized use.

2. Students, Creators, and Corporate accounts

Students purchase individual courses. Creators subscribe to a paid plan to publish and sell courses through their own storefront. Corporate accounts license courses to multiple seats under a written license term.

Creators are independent sellers. Courses are the responsibility of the Creator who publishes them. We provide the hosting, payment, and delivery infrastructure; we do not author, endorse, or guarantee any course content or outcome.

3. Creator subscriptions — recurring billing

Automatic renewal notice. Creator plans are subscriptions. By subscribing you authorize us and our payment processor (Stripe) to charge your payment method the plan price automatically on a recurring basis — every month for monthly plans, or every 12 months for annual plans — until you cancel. Your subscription renews automatically at the end of each billing period at the then-current rate, including all applicable taxes. Plan prices are shown before checkout and on your Stripe receipt.

Billing date. Your first charge occurs when you subscribe. Each renewal charge occurs on the same calendar day of the following period. If that day does not exist in a given month, the charge occurs on the last day of that month.

Cancellation. You may cancel at any time from Account → Manage billing, which opens the Stripe billing portal. Cancellation stops future renewals; it does not retroactively refund the current period. You retain Studio access through the end of your paid period, plus a 30-day grace period during which your courses are hidden from the public catalog. At the end of that 30-day grace period your courses, chapters and uploaded video files are permanently deleted from the Platform and from our video host, your Creator access ends, and students who purchased your courses lose access. Deletion is permanent. Download or back up any content you wish to keep before the grace period ends, and give your students notice.

Plan changes. Upgrades and downgrades take effect immediately and are prorated by Stripe against your current period.

Price changes. We may change subscription prices. We will give you at least 30 days' notice by email before a price change takes effect on your account, and you may cancel before renewal if you do not agree.

Failed payments. If a renewal charge fails, we may retry it. Continued failure may result in suspension or cancellation of your Creator access.

4. Platform fees & payouts

In addition to the subscription price, we retain a 5% platform fee on each public course sale; Creators keep 95%. Corporate (B2B) license sales carry a 20% platform fee, which covers corporate-scale video streaming. Where a course is sold through an approved collaboration, the agreed revenue split applies to the amount remaining after the platform fee.

Payouts are processed by Stripe on Stripe's schedule and are subject to Stripe's terms, identity verification, and any holds Stripe applies. Creators are solely responsible for their own tax reporting and obligations.

5. Course purchases & access

Course purchases are one-time payments granting unlimited, unexpiring access to that course for the purchasing account. Access is personal and non-transferable, and continues if the Creator unpublishes the course or changes its price.

Important limitation — access depends on the Creator's subscription. Courses are hosted on My Course Academy on behalf of independent Creators. If a Creator cancels their Creator subscription or closes their account, their courses, chapters and video files are permanently deleted from the Platform and from our video host 30 days after their paid period ends, and your access to those courses ends at that time. This is disclosed at checkout. We will make reasonable efforts to notify purchasers by email before deletion so you can complete the course. Deletion is permanent and cannot be reversed.

If a course you purchased is deleted for this reason within 30 days of your purchase, contact us and we will refund that purchase.

6. Refunds & cancellation rights

Course purchases may be refunded within 14 days of purchase if you have consumed less than a substantial portion of the course, at our reasonable discretion. Subscription charges are generally non-refundable for periods already begun, except where required by law.

Consumers in the EU/UK have a statutory 14-day right of withdrawal for digital content. By starting a course or publishing with a Creator plan immediately after purchase, you request immediate performance and acknowledge that your withdrawal right ends once delivery has begun. Nothing in these Terms limits mandatory consumer rights.

7. Content, ownership & licence

Creators retain ownership of the content they upload. By uploading, a Creator grants us a worldwide, non-exclusive licence to host, encode, stream, display, and promote that content for the purpose of operating the Platform, and to deliver it to purchasers.

Creators warrant that they hold all rights necessary to sell their content and that it does not infringe third-party rights. Students may not download, copy, redistribute, resell, or publicly perform course content. Video is delivered through short-lived, signed playback URLs; circumventing these protections is prohibited.

8. Acceptable use

You may not use the Platform to publish unlawful, hateful, harassing, deceptive, sexually exploitative, or infringing material; to make false claims about credentials, outcomes, or medical, legal, or financial results; to scrape or reverse-engineer the service; or to interfere with its security or availability.

Users can flag courses and storefronts. We may review, restrict, unpublish, or remove content and suspend accounts that violate these Terms.

9. Copyright complaints

If you believe content on the Platform infringes your copyright, send a notice including the work concerned, the URL of the material, your contact details, and a statement of good-faith belief and accuracy, to the contact address below. We remove infringing material and terminate repeat infringers.

10. No professional advice; disclaimers

Courses are educational only and are not medical, mental health, legal, financial, or other professional advice. Consult a qualified professional before acting on course material, especially where physical activity or health is involved.

The Platform is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total aggregate liability arising out of or relating to the Platform is limited to the greater of the amount you paid us in the 12 months preceding the claim, or USD $100.

12. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Platform, or your breach of these Terms or of applicable law.

13. Privacy & data

We collect the account, purchase, usage, and support data needed to operate the Platform. Payment card details are handled by Stripe and never stored by us. Video is hosted and streamed by our video infrastructure provider. We do not sell personal data. You may request access to or deletion of your account data by contacting us or using the account deletion option in your Account page; some records are retained where required for tax, accounting, or fraud-prevention purposes.

14. Suspension, termination & changes

You may close your account at any time. We may suspend or terminate accounts that breach these Terms, create legal risk, or repeatedly exceed plan usage limits after warning. We may modify these Terms; material changes will be posted here with an updated date and, for subscribers, notified by email before they take effect.

15. Governing law & disputes

These Terms are governed by the laws of the State of Idaho, USA, without regard to conflict-of-law rules, and the state and federal courts located in Idaho have exclusive jurisdiction, except where mandatory local consumer law provides otherwise. Before filing a claim, please contact us so we can try to resolve the matter informally.
